IDIADA will use your Personal Data described below for the following main purposes:

For example, We will seek your consent to process and use certain types of Personal Data where We are required to do so by law (e.g., in connection with our direct marketing activities or where We process sensitive data).

Lawful basis

IDIADA will process your Personal Data on the legitimate grounds of legitimate interest and consent.

This refers to information that identifies You personally and that IDIADA needs in order to achieve the purposes described above. Therefore, IDIADA, depending on the relationship it has with you, may collect the following:

·     Your payment and transaction details where necessary (bank account number, account holder, etc.);

·     Where You have given your consent, your preferences regarding the commercial information We will provide;

·     IDIADA's affiliated companies where appropriate.

·     Law enforcement agencies, judges and courts, regulatory bodies, governmental authorities or other competent third parties.

PRIVACY POLICY

 

This Privacy Policy describes the way in which IDIADA Automotive Technology, S.A. (hereinafter "IDIADA" or "We") collects and processes your Personal Data, as well as the way in which it uses and protects it, and the rights You have in relation to it within the framework of the IDIADA Digital Solutions internet commerce platform (hereinafter "Website"). In this regard, IDIADA informs You that it will collect and process Personal Data in its capacity as data controller.

“Personal Data” means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

 The Personal Data that We will process about You relates to the following categories of data:

  • Your professional information;
  • Your payment and transaction details where necessary (bank account number, account holder...); and
  • Where You have given your Consent, your preferences regarding the commercial information We will provide;

Please note that We are required to collect certain Personal Data by law, or as a consequence of the contractual relationship We have entered into with you. Refusal to provide such information may prevent or delay the fulfilment of such obligations. When collecting your Personal Data, We will inform You about the obligation to provide such data, as well as the consequences of not doing so.

  • As mentioned in Clause 5 of this Privacy Policy, among others, for communications to any of our employees, officers, agents, business partners, subsidiaries of the Applus Group, who process the Personal Data for the purposes described in this Privacy Policy;
  • In order to allow third-party service providers and suppliers contracted by IDIADA to access the Personal Data in order to provide us with the services necessary to comply with the purposes described in this Privacy Policy; and
  • For any communication to third parties as necessary as part of due diligence processes in the context of corporate restructuring transactions to which We are a party, in line with the provisions of [Section 5 (d)] of this Privacy Policy;

When IDIADA processes Personal Data on the basis of its legitimate interests, it will always perform a balancing test in order to ensure that your interests or your fundamental rights and freedoms do not override our legitimate interests and will implement stringent safeguards to ensure that your privacy is protected accordingly.

We will process your Personal Data for the following purposes, provided that You have given your prior consent:

  • To send You newsletters and/or promotional emails about our own products and services, unless You expressly state your wish not to receive such commercial communications, or where it is not legally permissible to send them to you; and

We will also process your Personal Data in order to ensure an optimal level of compliance with current legal obligations to which IDIADA is subject, as well as to cooperate with regulatory authorities and law enforcement agencies, when necessary, as set out in Clause 5 of this Privacy Policy: 

  • To communicate your Personal Data, as well as other supplementary information, in response to requests issued by competent authorities and/or entities, as provided for in applicable legislation or by law enforcement officials in the exercise of their duties.  
  1. What rights do You have in relation to your Personal Data?

 You have certain rights in relation to your Personal Data, subject to the provisions of law. These rights include:

  • Know how We are processing your Personal Data and access this Personal Data;
  • To request rectification of inaccurate or incomplete Personal Data;
  • Request the deletion of your Personal Data when it is no longer necessary for the purposes for which it was collected, in accordance with applicable law;
  • Limit the processing of your Personal Data, under certain circumstances (in which case We will only process the Personal Data for the exercise and/or defence of IDIADA's rights); 
  • Object to the processing of your Personal Data, taking into account certain circumstances and on grounds relating to your particular situation (in which case We will only process the Personal Data for compelling legitimate grounds or for the exercise and/or defence of IDIADA's rights); and
  • Exercise your right to data portability, which will allow You to receive and re-use the Personal Data in an electronic format usable for your own purposes and for different services without hindrance to its use, including its transmission to a third party.

We encourage You to contact Us to update or correct your personal information as soon as it changes, or if the Personal Data We hold about You is inaccurate.

IDIADA is committed to protecting your Personal Data as set out in this Privacy Policy, and in accordance with applicable law. If You have any queries or would like to request further information on how to exercise your rights, please do not hesitate to contact Us. 

  1. With whom and how do We share your Personal Data?

 IDIADA will share your Personal Data with third parties in the following circumstances:

  • Companies belonging to the Applus+ Group: IDIADA works closely with other companies belonging to the Applus+ Group. However, We will share your information with them only when strictly necessary.
  • Law enforcement agencies, judges and courts, regulatory bodies, governmental authorities or other competent third parties: We may share your Personal Data with these third parties when We deem it necessary to comply with a legal or regulatory obligation, or to otherwise protect our own rights as well as the rights of third parties. 
  • With IDIADA's third-party providers: IDIADA may share your data on the basis of legitimate interest in order to (i) efficiently manage the sending of commercial communications and the publication of your ratings and opinions to our Website; (ii) ensure the proper functioning of the Website and to be able to fulfil the purpose of the Website and the purposes described in this Privacy Policy.
  • Asset purchasers and mergers: We will share your Personal Data with any third party who purchases, or to whom We transfer, all or substantially all of our assets and business or with those with whom We enter into a merger, consolidation, integration or similar restructuring. In the event of such a sale or transfer, We will use reasonable efforts to ensure that the entity to which We transfer your Personal Data treats it in a manner consistent with this Privacy Policy.
  • Other third parties: We will only share information with third parties if You provide your unambiguous consent.

 We implement technical and organisational measures to ensure a level of security appropriate to the risk to the Personal Data processed. These measures are intended to ensure the continued integrity and confidentiality of the Personal Data. We evaluate these measures on a regular basis in order to ensure the security of the processing.

 Your Personal Data will be kept for as long as they are necessary for the purpose for which they are processed. Your Personal Data will be blocked when they are no longer necessary for the purpose for which they are processed in order to comply with IDIADA's various legal obligations. We will then proceed to delete your Personal Data. In the event that there is information which, for technical reasons, We cannot completely remove from our systems, We will take appropriate measures to prevent any further processing or use with respect to such data.

 You have the right to request a copy of this Privacy Policy using the contact details set out above. This Privacy Policy is subject to change as deemed necessary.

In the event that We modify this Privacy Policy, We will notify You of the changes. In cases where changes to the Privacy Policy have a fundamental impact on the nature of the processing, or otherwise have a material impact on You, We will notify You in sufficient time to give You an opportunity to exercise your rights (e.g., but not limited to, objecting to the processing).

In addition, and to the extent that IDIADA relies on consent to carry out any of its processing activities, We will ensure that We seek your consent where the above changes may have a material impact on the processing in question before such changes become effective.
